My Wife Gets ahold of Alan Pearlman

So my wife called Alan Pearlman at home. . .and got a hold of him. He yelled at my wife for asking for her deposit/money.

1) He is annoyed about my negative review on Apartments.com
2) he states that he did us a FAVOR by letting us Sublease (I see it as he made us sublease vs. renting per the Ohio law).
3) he told my wife that he is out of money, his business is bad. . .blah blah blah.

My thoughts:

A deposit is not a cash flow, it isn't to be used to keep your business going. It is suppose to stay in an account and earn interest!!

I didn't violate the laws of Ohio. . .I did everything by the book. I didn't try to not pay ALAN when I LOST MY FREAKING JOB. . .

MAYOR

Just sent a letter to the Mayor of Shaker Heights.

After that I will start blasting news outlets. Who knows if anyone will listen, but it can't hurt. I can't give up without a fight. . .

Lawyer rejected

Lawyers say "ha ha ha ha ha, take a hike" on this one. . .

Man, if you are a landlord I can see why it is so tempting to steal. I can't go to Small Claims (I'm in IL now plus I have read he plays dirty in small claims, keeps stretching it on until you give up).

Rejection from State Attorney General

Well - Apparently Landlords can commit fraud and the Attorney General just doesn't care. . .

The Story So far

I am starting this blog because Alan Pearlman from AGP Realty, Inc stole my money (about a $1,000). I'm not talking a lanlord just keepign your dough and a nice itemized list. . .I'm talking just keeping your money. Hides from you. LIes to your face when you ask him when the check will be mailed. . .that kind of stuff. I hope that I can prevent this from happening to others!


I executed a lease between myself and Alan G. Pearlman’s company, Pedra Properties LLC. The lease term started on September 1, 2007 and ended on May 31, 2008. I paid a total of $1075 deposit per our Agreement. This lease was for Shaker Regency apartment 306 at 3210 Warrensville Center Road, Shaker Heights, Ohio 44122.

During the course of the lease I lost my job (OUCH great time for someone to steal $1,000 bucks from you).

I found another tenant (David and Cathy). Alan Pearlman refused to write a new lease for this couple and instead had me execute a sublease agreement. This transaction occurred at the end of February. I sent all keys and garage door openers to Alan Pearlman and cleaned out the Apartment prior to leaving.

As I had already moved out of state at that time (new Job in Chicago), Alan met with the couple, had the couple sign the sublease, and collected their deposit. As the Agreement was between Cathy, David, and me, Alan was supposed to mail the deposit to me for the total $975 that Cathy and David paid. Alan kept the deposit and never returned the money to me as he had promised on February 26, 2008 (I have the email, I'll attach it later).

Upon Alan’s request, Cathy and Dave moved out on May 24th, 2008 a full 7 days before the end of my Lease Agreement. This was at Alan’s demand (you must move out by May 24th) in a conversation between Alan and me.

Both Cathy and my wife have contacted Alan multiple times. Half the time he does not even return the calls or e-mails. The times they have gotten to talk to Alan, Alan has promised to send the checks and itemized list(s) regarding the deposits. Alan Pearlman has promised to mail the deposit multiple times, but has not yet sent me the checks. According to Ohio law the landlord has 30 days to return the deposit and may not deduct for reasonable wear and tear. The 30 day period has come and passed as of June 30th, 2008.

Upon review of Alan on the Internet I do not believe that we are an isolated incident. I believe that Alan is taking advantage of both Cathy, David, and my status as former Ohio residents. Our situation is not unique. According to Apartment Ratings it is advised NOT to pay Alan Pearlman your last month’s rent as he will not return your Security deposit (attached). This is a situation that needs to be resolved not only for myself, but for the already hurting residents of Cleveland. I am sure a quick search on Google using “Alan Pearlman”, “Pedra Properties”, or “AGP Realty” will turn up far more evidence than I have included below.


Don't get caught by this guy, avoid the following apartments:

Shaker Regency Apartments
Continental Luxury Apartments
Roosevelt Apartments
Boulevard View Apartments


I wish I knew this stuff ahead of hand, I would rather kept the last month deposit and force him to send the itemized list and pay him. . .
